Ruling likely Monday on Bluffdale dispute

A judge is expected to rule Monday on whether former state Rep. Dave Hogue can be recognized as Bluffdale's administrative services director.

Third District Judge Kate Toomey listened to a second day of testimony and arguments Friday over Bluffdale Mayor Claudia Anderson's decision to appoint Hogue to the city staff position without the consent of the City Council.

Anderson filed a lawsuit against the five members of the City Council last week after they unanimously passed a resolution and an ordinance challenging the legality of her action and stating that Hogue is not a member of staff. The City Council responded to the lawsuit by filing a request for injunctive relief, asking that a judge settle the matter.

The crux of the debate is whether Bluffdale's administrative services director is considered a department head or a mayor's assistant and deputy.
