According to the lawsuit, members of UARC attended June 29 events in Taylorsville, talked to people and handed out leaflets. The three were told by a city police officer they could not do what they were doing outside of the "free-speech zone." The group was also warned that if they continued, they would be cited and criminally charged for their conduct.
Barnard said that under the city's ordinance, political candidates would be relegated to the "bull pen" the city has created.
Jenkins recalled that as a young boy, he was paid a penny for every flier he handed out for a political candidate at Liberty Park in Salt Lake City. Jenkins said he found no compelling city interest in prohibiting political or activist conversation and leafletting outside a zone.
Stirba said the city will comply with the order, which expires on July 7, when attorneys will again meet to consider the entirety of the lawsuit.
The UARC is seeking unspecified damages against Taylorsville and payment for attorney fees.
