Provo intent on razing inn

City OKs the use of eminent domain for a new arts center

"The court sets the value," West said. "Not the city, the city council, the mayor, the owner. The court. The owner will receive just compensation under our Constitution."

Councilmember Council member Steve Turley praised the city's efforts to find a resolution.

"I commend city staff's and mayor's efforts to replace a family's livelihood," Turley said. "I wouldn't be able to vote for this if it wasn't for a public purpose. If it was for a Wal-Mart, I wouldn't vote for it. I think we've shown clearly it's for a public purpose."

Patel's attorney, Matt Jube, asked the council to delay action until the final appraisal was reviewed, and council member Councilmember Paul Warner proposed holding a special council meeting on Friday. However, the council voted 6-0, with Warner's abstention, to move forward.
