10 Commandments up in air in Pleasant Grove

The judge did not, however, address the specifics of the Pleasant Grove monument. And that, Barnard said, will be the next step in the lawsuit. The court will have to examine how and why the monument was placed in the park, who put it there and whether it was done for religious or secular purposes.

Other park displays must also be taken into account, Barnard said, which is where a new lawsuit against Pleasant Grove may come into play. On Friday, Barnard filed suit against the city on behalf of the religious group Summum, asking that it be allowed to erect a monument touting its Seven Aphorisms near the park's Ten Commandments monument.

Pleasant Grove City Attorney Christine Peterson was unaware of the 10th Circuit's action when contacted Monday and therefore unable to comment on the decision.

An appeal of a lawsuit challenging the display of a Ten Commandments monument in Duchesne is still pending before the 10th Circuit. That case is slightly different than the Pleasant Grove matter, however, because the tablet no longer sits on city property.
